Mass Casualty Event at Astroworld Music Festival

11/11/2021 Update: Since the time of publishing this post, one more person has died of their injuries. The total number of deaths from the Astroworld Music Festival Mass Casualty Event is now 9.

WHAT HAPPENED AT THE ASTROWORLD MUSIC FESTIVAL?

Eight people have been confirmed dead after a Travis Scott performance at the Astroworld Music Festival in Houston, Texas, on 5 November 2021.

Hundreds of other injuries have been reported and continue to be reported.

Event organizers have canceled the second night of the festival amid the death and destruction that took place on Friday night.

Reports have surfaced of people being injected with an unknown substance. At least one person has died of cardiac arrest.

The youngest victims were in high school, and some of the deceased were identified by their schools. Family members identified other victims. All eight victims have since been identified.

WHO IS RESPONSIBLE FOR THIS TRAGEDY?

The question of who is responsible for the events that took place has yet to be answered. This is likely a case that will fall under premises liability, meaning that it will likely be the venue owners and event organizers who will primarily be held responsible. NRG Stadium and Live Nation could both be held liable in this instance.

Mass-casualty events at music festivals and concerts are unfortunately not a new thing. This has happened in the past, more than once. The most notable mass-casualty event during a concert took place in Las Vegas, Nevada, when a shooter opened fire on a crowd of people, killing 58 and injuring hundreds more. In this case, the MGM Grand and others were found liable for their negligence in allowing this to happen. The Astroworld Music Festival mass-casualty event will hold many similarities to this case.

IS TRAVIS SCOTT RESPONSIBLE FOR THESE DEATHS AND INJURIES?

Many people could see the liability of Travis Scott in this situation, who–even when ambulances were in the crowd and fans were screaming for him to stop the show–kept the concert going on. Is this negligence? Mr. Scott is no stranger to inciting riots, even pleading guilty in 2018 to inciting a riot at his concert, and this case may be no different. Had he only lost his shoe during Astroworld, more people might still be alive today. While some blame may fall on Mr. Scott for his failure to stop the madness, others will likely hold much more responsibility for this event.
